The Eagle Lake Improvement Association continues attempts to stall a public access development on Eagle and Juno lakes.
According to local newspaper reports, the association, Eagle Lake Dock LLC, Michael Mrocezk and Glenn Neely have filed a lawsuit against Ontwa Township, the Ontwa Zoning Board of Appeals and the Michigan DNR with hopes of overturning the ZBAs Feb. 25 decision that approved the DNRs zoning application. The lawsuit charges that the DNR access doesnt constitute a park.
Ontwa Township Supervisor John Brielmaier declined to comment on the lawsuit, saying only that township attorneys were reviewing the suit with lake association attorneys.
Meanwhile, a DNR spokesman said his agency is moving forward and will have an engineering plan ready by April 11. Once completed, the DNR will conduct an onsite review with the Cass County Road Commission and meet its board for comments.
The DNR purchase of the property, which lies north of the Dock property and adjacent to the Christiana Channel, is in its final stage and awaits closing to consummate the acquisition from 1st Source Bank.
